ACCEPTANCE OF ORDERS
Orders will only be accepted via the online form or via post including the downloadable order form accompianed by a cheque for the full amount. Jacamar (UK) Limited reserve the right to refuse publication of any material should it be deemed likely to cause offence, libel or discrimination. Jacamar (UK) Limited shall be indemnified by the customer in respect of any claims, costs and expenses arising out of any libelous matter or any infringement of copyright, patent, design or any other proprietary or personal rights contained in any material printed for the customer. The indemnity shall extend to any amounts paid on a lawyer's advice in settlement of any claim.

ORDER CONFIRMATION
All on-line orders will automatically receive an order confirmation via email. Once received, all posted orders will receive order confirmation (if accepted) via email by the next working day.

DESIGN & ARTWORK
Should a commission including design & artwork be cancelled or postponed by the client part-way through, Jacamar reserve the right to charge for all hours (at our standard rates) and expenses incurred to-date.
In regard to concepts and initial design work, Jacamar will have quoted for this within the 'Confirmation of Order', and usually state how many options will be produced. Whilst there is an element of subjectivity to design, Jacamar will provide solutions to a professional standard, that answer the brief provided by the customer. Tweeks & adjustments are expected and allowed for. This work carries a fixed, fully liable price independent of the client’ own opinions and is not subject to cancellation once the ‘Confirmation of Order’ is signed. In balance to this, it is of course our desire to fully satisfy clients expectations, and Jacamar will, where deemed appropriate, continue to rework and adjust designs until the customer is happy.

MANAGEMENT OF CHANGES
1 set of customer changes to the message / logo / signature arrangement are allowed for within price. All further requested changes will be quoted, billed and paid for before printing can commence. N.B This does not need to happen - make certain of your content before making the order!

PROOF ACCEPTANCE
We supply proofs of the cards via email as PDFs before printing. The purchaser's reply with approval to print is a commitment to accept the order as presented in the proof. No further changes can be made. Printing may proceed immediately after approval, thus incurring commitment to full costs even if this is within 7 days of ordering. Jacamr (UK) Limited will incur no liability for any errors not corrected by the customer within the proofing stage.

PAYMENT
All card printing orders must be paid for in full before printing can take place. Where original designwork is commissioned and final cost is not fixed, credit for this separate process may be offered at the discretion of Jacamar (UK) Limited. All credit offered is on a 30 days from invoice basis. Failure to pay in full within this period may affect delivery of related or unrelated orders.

PRICES
We reserve the right to increase advertised prices at any time. All orders taken before that price change will be honored at the previous price.

DELIVERY
All orders taken with artwork approved before November 16th 2007 will be delivered by the end of the 1st week of December. However, we print to order, and aim for most orders be delivered within 10 working days of artwork approval. Should you have need for an urgent order, please contact us first to confirm delivery dates.
Jacamar (UK) Limited will make every effort to deliver as speedily as possible and within estimated dates, but they do not offer any guarantee of delivery date, nor shall they be liable from any damage or claims of any kind in respect of delivery, except where the customer pays for insurance against damage at the time of order. Insurance of goods shall be the responsibility of the customer from the time the goods are left with the customer or customer's agent at the customer's designated address.

COPYRIGHTS & OWNERSHIP
All material published in our cards is copyrighted either by Jacamar (UK) Limited or by our suppliers. The card purchaser has no copyright whatsoever, and may not reproduce the material via any means without the express permission in writing by Jacamar (UK) Limited.
Ownership of printed materials shall not pass to the customer until payment in full has been received.

CUSTOMER'S PROPERTY SUPPLIED
All and any files supplied by the customer in relation to a purchase shall be held at the customer's risk. Every care will be taken to gain best results with materials/files supplied, but responsibility will not be accepted for imperfect work caused by defects in, or unsuitability of those materials/files.

LIABILITY
Jacamar (UK) Limited shall not be liable for indirect or consequential loss to the customer/s or from 3rd party claims occasioned by errors in carrying out the work commissioned or by delay in delivery. In any event, the extent of Jacamar (UK) Limited's liability shall be limited to the contract price.

REFUNDS
All orders may be cancelled in writing within 7 days of order receipt. Please note - our Christmas cards are printed to order and all costs incurred to date at the time of cancellation will be fully liable and not refunded unless the cards supplied are proved defective or damaged. Most of our costs are incurred when printing has started. Printing will not start until the order has been paid for in full, and an approval received for the printing proof provided.

RETURNS
Returns will only be accepted for reprinting if: damaged in transit, misprint caused by us (and therefore different to the approved proof), incorrect item delivered or a clear defect in the quality of production. All rejected cards must be returned (via our courier) before reprinting can take place.

STORAGE
Jacamar will undertake to store all files supplied by the customer for a minimum period of 13 months from supply date. Jacamar may dispose of all and any goods after this period without notice.

FORCE MAJEURE
Jacamar (UK) Limited shall be under no liability if they are unable to carry out any provision of contract for any reason beyond their contro (without limiting the forgoing), act of God, legislation, war, fire, flood, drought, failure of power supply, lock-out, stike or other action required for the performance of the contract. During the continuance of such a contingency, the customer may by written notice to Jacamar (UK) Limited elect to terminate the contract and pay for work done and materials used, but subject therto shall otherwise accept delivery when avilable.

LAW
These conditions and all other express terms of the contract shall be governed and construed in accordance with the laws of England.

ACCEPTANCE OF TERMS AND CONDITIONS
By placing an order with Jacamar (UK) Limited, which the customer does not cancel within the prescribed period, the customer is deemed to have accepted Jacamar (UK) Limited's standard terms and conditions.
